Section 6. Vacancies on Executive Council
Vacancies occurring in the Executive Council arising on account of the
death, resignation or termination of office under any provision of
these bylaws shall be filled as follows:
(a) Any vacancy arising in the office of member at large or alternate
member shall be filled by appointment by the president for the
unexpired term, provided that any alternate member appointed by the
president shall have either an office or residence in the same
Congressional District as the alternate member whose position he or she
fills.
(b) Any vacancy arising in the office of president shall be filled by
the president-elect (who shall continue to hold the office of
president-elect until the expiration of unexpired terms and shall
continue to serve for the term during which he or she would regularly
have served as president.
(c) Any vacancy arising in the office of president-elect shall remain
unfilled for the unexpired term. An election for the office of
president shall be held at the next election held by mail-out ballot in
the same manner that the election is held for the office of
president-elect. In such event, Atlanta Judicial Circuit residents
shall be eligible for the office of President in even-numbered years
and non-Atlanta Judicial Circuit residents shall be eligible in
odd-numbered years, with Atlanta Judicial Circuit residents defined as
in Article IV, Section 2(b).
(d) Any vacancy arising in the office of secretary or treasurer shall
be filled for the unexpired term by such person elected at the next
regular meeting of the Executive Council by majority vote of those
present and qualified to vote and voting.
(e) Any vacancy arising in the office of editor of the Young Lawyers
Division Newsletter shall be filled for the unexpired term by
appointment by the president.
(f) Any vacancy arising in the office of chairperson or vice
chairperson of a committee shall be filled for the unexpired term by
appointment by the president or the president may delegate the
appointment to the members of said committee.
(g) Any vacancy arising in the office of director shall be filled for the unexpired term by appointment by the president.
(h) Any vacancy arising in the office of the nonresident member and/or
nonresident alternate member shall be filled by appointment by the
President, and the persons so appointed shall hold office for the
unexpired term, so long as such person is an active member of the Young
Lawyers Division, in good standing, and resides outside the State of
Georgia.
